Terms of service

CONTENT• I accept characters of any gender, sexual identity, or gender expression, as well as furry, animals, creatures, non-human characters, mechas, robots, and complex machinery.• Battle scenes are allowed, including cartoon or implicit violence.• I do not accept hateful content, including harassment, dehumanization, or jokes targeting a person or group.• I do not accept explicit or detailed violence, including gore or self-harm.• Nudity and sexual scenarios are accepted for adult characters only.• Sexual, suggestive, or otherwise inappropriate content involving children or child-like characters is not accepted.• I reserve the right to decline a request depending on its specific context, even if it technically falls within an accepted category.
PROCESS• The request will be reviewed before being accepted. Work will begin once 100% or at least 50% of the payment has been received.• If a 50% payment is chosen, the remaining balance must be paid before the commission can continue to the next steps.• The commission progress will be tracked through a Trello board, which the client may check at any time. It will include the current status, estimated delivery date, pending tasks, and other relevant information.• WIP updates may be provided as images throughout the commission. These are not scheduled and do not necessarily represent the exact current state of the artwork; they are intended to show its general appearance and progress.• Finished artwork will normally be delivered as a full-resolution PNG file.• Alternate versions will be included when they were specified as part of the commission.• Delivery dates depend on the complexity and scope of the commission. The estimated delivery date will be visible through VGen or Trello and may be adjusted if necessary. Significant changes to the delivery date will always be notified.
REVISIONS & CHANGES• Minor revisions are included during the sketch stage.• Major changes, such as changes to the pose, composition, or character design, should be requested as early as possible.• Changes requested during the final stage or after completion may incur an additional fee, depending on the complexity of the change.• Once a stage has been approved, major changes to previously approved elements may require an additional fee.
REFUNDS & CANCELLATIONS• Refund requests are handled case-by-case, depending on the current stage of the commission.• If a commission is cancelled before any work has started, a full refund may be issued.• Once work has started, the refundable amount may be reduced according to the amount of work already completed. Completed work is not refundable.• Once the final artwork has been delivered, the commission is considered completed and is generally non-refundable.• If I need to cancel a commission, I will refund the portion of the payment corresponding to any work that has not been completed.• If a client becomes unresponsive for an extended period of time, the commission may be placed on hold or cancelled. Any refund in this situation will depend on the amount of work already completed.
SOURCE FILES & DELIVERABLES• The standard commission delivery includes the finished PNG file in full resolution.• PSD, KRA, CSP, or other editable/source files are not included by default, unless explicitly stated in the commission description or agreed upon before payment.• Some commission types may include additional files or assets as part of their standard delivery. For example, character reference sheets may include organized editable layers for the character base, final poses, expressions, props, or other elements when specified.• The exact contents of the final delivery depend on the commission type and what was agreed upon before payment.
AI & GENERATIVE CONTENT• Commissioned artwork may not be used to create, train, or assist Generative AI systems or AI-generated content.• This includes, but is not limited to, using the artwork as training data, prompts, image-to-image input, image references, or for generating derivative AI content.• Clients who knowingly violate this rule may be blacklisted from future commissions.
COPYRIGHT & USAGE RIGHTS• Purchasing a commission does not transfer the copyright or ownership of the artwork to the client unless explicitly agreed upon in writing.• The client receives the usage rights associated with the commission's license.• Personal-use commissions may not be used for commercial purposes without obtaining the appropriate commercial license.• The client may not resell, redistribute, trace, claim the artwork as their own, or transfer its rights to another person or business unless explicitly agreed upon.• Additional usage rights may be available depending on the commission and can be discussed before payment.
PERSONAL & COMMERCIAL USE• Unless a commercial license has been purchased or otherwise agreed upon, commissioned artwork is intended for the client's personal use only.• Personal-use artwork may not be used to manufacture or sell merchandise, create commercial products, promote a business or monetized service, or be resold as a standalone product.• Artwork may not be licensed or transferred to another person or business without permission.• If you are unsure whether a particular use counts as commercial use, please ask before using the artwork commercially.
ARTIST RIGHTS & ARTWORK USAGE• I reserve the right to decline or cancel any commission that violates these terms or makes me uncomfortable.• By default, completed commissions may be posted a few days to one week after completion, including a watermark and the client's username as credit.• If you do not want your commission posted publicly, please let me know before or during the commission process.• Paid artworks may be used to advertise my services, including portfolio pieces, commission examples, art raffles, timelapses, speedpaints, reels, social media posts, and other general marketing for my brand.• If a commission is marked as private, it will not be used for my portfolio, examples, timelapses, raffles, or other general marketing.• The artwork will not be used by me to create merchandise or sold as a product.
CREDIT• Any content that uses commissioned artwork, such as YouTube videos, social media posts, or similar content, must include credit the first time the artwork is used.• A simple credit such as “Artwork by @AnaDrawZone” in the video description, post, quoted post, or equivalent location is enough.• Repeatedly ignoring this requirement may result in being blacklisted from future commissions.
CLIENT RESPONSIBILITIES• Clients must provide clear references and descriptions before work begins and whenever additional information is requested.• Images are not always necessary, but they are strongly recommended and help me understand the requested result.• Clients are expected to respond when their input, approval, or additional information is required.• Delays caused by a lack of response, missing information, or late approvals may affect the delivery timeline.
CLIENT INACTIVITY• If a client becomes unresponsive for an extended period of time, the commission may be placed on hold.• If there is no response after reasonable attempts to contact the client, I reserve the right to cancel the commission.• Any refund in this situation will depend on the amount of work already completed.• A commission placed on hold due to client inactivity does not guarantee that the original delivery date will remain available.
CLIENT CONDUCT & BOUNDARIES• Commissioning me does not entitle anyone to special treatment, constant personal attention, or friendship.• I treat DMs, requests, gifts, and interactions related to commissions as part of my business.• Please do not pressure me into providing special “friend” treatment or try to force a personal relationship.• Gifts, frequent commissions, or the amount of money spent on commissions do not create an obligation for personal attention or friendship.• Friendship takes time and cannot be forced. I'm simply a bit shy!
CHARGEBACKS & PAYMENT DISPUTES• Clients are expected to contact me first if there is an issue with a payment or commission.• Filing an unauthorized chargeback or payment dispute after receiving the commissioned artwork may result in a permanent blacklist from future commissions.• In the event of a payment dispute, I reserve the right to provide the payment provider or platform with relevant commission records, including messages, payment information, approvals, and delivered files.
FINAL NOTE• By commissioning me, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
